SMS Terms & Conditions

1. Program Overview

Banko Overhead Doors, LLC (“Banko,” “we,” “us,” or “our”) offers SMS/text message communications (“Messages”) to provide customers with important information related to our services, including appointment scheduling, service updates, billing notifications, promotions, and emergency service alerts. By opting in to receive Messages from Banko, you agree to these SMS Terms & Conditions (these “Terms”).

Delivery of Messages is subject to effective transmission by your carrier and coverage area. We are not responsible for delays or failures in delivery due to carrier issues, device compatibility, or circumstances outside our control.


2. Types of Messages

By enrolling in our SMS program to receive Messages, you agree to receive the following categories of Messages:

  • Appointment confirmations and reminders, and other scheduling notifications
  • Technician arrival notifications and service updates, and other service-related communications
  • Account servicing, invoice notifications, payment confirmations and reminders, and links to payment portals
  • Emergency service alerts and availability updates
  • Seasonal maintenance tips

You may separately consent to receiving promotional offers, discounts, and marketing Messages (collectively, “Marketing Messages”) from us pursuant to the opt-in terms in Section 4 regarding Marketing Messages.


3. Message Frequency

Message frequency varies based on your interaction with Banko, the services requested and if you have expressly opted in to receive Marketing Messages.


4. Consent & Automated Messaging Disclosure

Opting In. By providing your mobile phone number, you consent to receive Messages from us that are directly related to your account or services, such as scheduling notifications, appointment reminders, invoices, payment confirmations, and other service-related communications.

You may separately and expressly opt-in to receive Marketing Messages by:

  • Providing verbal consent to receive Marketing Messages during a conversation with a Banko representative;
  • Submitting an online form and selecting to opt-in to receive Marketing Messages; or
  • Notifying or replying to Banko via email and indicating therein that you wish to receive Marketing Messages.

Automated Messages. Messages may be sent using an automated messaging system or other automated technology.

Transactional Messages vs Marketing Messages. Transactional Messages (such as appointment reminders and service updates) may be sent based on an existing customer relationship. Marketing Messages will only be sent to customers who have expressly opted in to receive such Messages, in accordance with applicable law.

Consent Scope. Your consent applies only to the specific program(s), purpose(s), and phone number(s) identified at the time of opting-in. Separate consent will be obtained for any materially different program(s) or purpose(s).

Accurate Number. You represent that you are the owner or customary user of the mobile number you provide and that you will promptly notify us if you cease to be the subscriber or customary user of that mobile number. You agree to notify us if your mobile number changes and further agree to indemnify us for any and all damages that we incur as a result of your failure to notify us of a change of your mobile number.

 
5. Opt-Out & Revocation of Consent

You may opt out of receiving Messages at any time by replying STOP to any Message. You may also revoke your consent by contacting us at the address or email address below. After opting out, you will receive a confirmation Message, and no further Messages will be sent unless you re-enroll by providing new consent.

6. Fees & Carrier Charges

Banko does not charge for Messages; however, message and data rates may apply depending on your mobile carrier and plan. Please contact your wireless provider for details.


7. Privacy & Data Use

Records of your consent, your mobile number and other information collected for purposes of providing Messages, and Messages are handled and maintained in accordance with our Privacy Policy. Banko does not sell or share your mobile number with third parties for their marketing purposes. Message data may be stored to maintain records of consent, opt-out requests, and compliance with applicable laws.


8. Miscellaneous

Updates to Terms. We may update these Terms from time to time in our sole discretion, provided that material changes affecting the types of Messages, frequency, or consent will be presented to you and, where required by applicable law, we will obtain new consent.

Entire Agreement. These Terms, together with the consent disclosures presented at the time of your opt-in and our Privacy Policy, constitute the entire agreement regarding the subject matter hereof.

Governing Law. The laws of the State of Florida govern these Terms (without giving effect to conflicts of law principles).
